JUSTICE BIBEK CHAUDHURI ORAL ORDER 10-07-2024 It is submitted by the learned Advocate for the petitioner that the petitioner was made an accused on the basis of the complaint submitted by the opposite party no. 2 before the Court of the learned Judicial Magistrate, Ist Class, Danapur. The said case was registered as Complaint Case No. 297(C) of 2003, dated 01.05.2003, under Sections 147, 148, 341, 452, 380 and 448 of the I.P.C. and under Section 27 of the Arms Act.

2. During last 21 years the opposite party no. 2/complaint never appeared in the trial court to adduce evidence. No witness on behalf of the complainant was examined. However, the case is kept pending without any progress for last 21 years and the petitioner/accused is being

3. Considering the prolonged pendency of the instant case, the learned Judicial Magistrate, Ist Class, Danapur is directed to consider, if the above mentioned complaint case can be disposed of under Section 245 (2) of the Cr.P.C.

4. Such decision shall be taken within one month from the date of communication of this order.

5. With the above order, the instant Cr. Misc. is disposed of.
