Petitioner prays for bail in connection with Khagaria P.S.Case No. 221 of 2018 registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code. Petitioner against the petitioner is that he enticed away the sister of the informant from the house.

Submission of learned counsel for the petitioner is that the main allegation is against one Sanoj Thakur and petitioner is brother of said Sanoj Thakur and as such he has falsely been implicated in this case and he is in custody since 26.4.2018. Heard learned APP also, who has opposed the prayer for bail stating that the girl is still traceless. Having heard both sides and in the facts and

No.47175 of 2018 (3) dt.20-09-2018 2/2 circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S.Case No. 221 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to assist the police in tracing out the girl.
