The petitioner seeks bail in Laxmipur P.S. Case No.93 of 2013, registered under Sections 395 and 412 of the Indian Penal Code.

The petitioner is not named in the FIR. The informant alleged that while the informant and other Barati were proceeding on different vehicles, the dacoits came on road and stopped the vehicle at the point of sword, dagger and gun. They were looted.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of co-accused, Damodar Yadav. The petitioner is in jail since 26.08.2019 but he has not been put on TIP. No looted article was recovered from

Patna High Court CR. MISC. No.79369 of 2019(2) dt.04-12-2019 2/2 possession of the petitioner.

Considering the facts that name of the petitioner figured in the case in the confessional statement of a co-accused but even after being arrested on 26.08.2019, the petitioner ha not been put on TIP, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Laxmipur P.S.
