2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) ( b ) (c) of Bihar Prohibition and Excise Act 2016 and Sections 272, 273 , 420 of the IPC .

3 . It is alleged that 11.625 liters of foreign liquor has been recovered from motorcycle and one co-accused person was apprehended on the spot.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of the petitioner has been transpired only on the basis of confessional statement of other co-accused Abhishek Kumar. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the

Patna High Court CR. MISC. No.87888 of 2024(2) dt.20-01-2025 2/2 aforesaid recovery. Petitioner has got one criminal antecedent of similar nature in which he is on bail.

5 . Learned counsel for the State opposes the bail petition .

6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge IV cum- Exclusive Special Excise Court No. II Gopalganj in connection with Kuchaikote Police Station Case No. 138 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
