====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Bhagwanpur Hat P. S. Case No. 313 of 2025 in a case registered for the offences punishable under Sections 190, 191, 192, 126(2), 127(2), 115(2), 118(3), 109, 103, 62(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.

3. It is a case of triple murder. As per prosecution case, 15 named accused persons, including these petitioners and 10/15 unknown persons, committed alleged occurrence.

4. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been

He further submits that though these petitioners are alleged to have fired with firearms but none of the deceased sustained any firearms injury rather they received injuries caused by sharp-cutting or hard blunt substances. Besides this, F.I.R. has been lodged after inordinate delay of more than two days without any explanation which renders the entire prosecution case doubtful. Petitioners claim clean antecedent and are in custody since 15.09.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the materials available on record, cause of death, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Bhagwanpur Hat P.
