The petitioner is apprehending his arrest in connection with Turkauliya P.S.Case No.36/19 dated 20.1.2019 registered for offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

As per FIR, police got information that the petitioner and one accused person were selling liquor by constructing temporary hut and on information, the police raided there but the accused persons succeeded in fleeing away. Submission of the learned counsel for the petitioner is that the hut does not belong to the petitioner . He has no criminal antecedent.

No.75573 of 2019(2) dt.26-11-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is dismissed.
