2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(4) of the Bharatiya Nyaya Sanhita.

3. The case of the prosecution is that when the informant namely, Bishundeo Chaudhary was returning from railway station to his house, two unknown miscreants on a black splendor bike intercepted him and on gun point, took away his bike and mobile.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is also submitted that the FIR was lodged against unknown miscreants. During course of investigation, one Avnish

Patna High Court CR. MISC. No.85162 of 2024(3) dt.10-02-2025 2/2 Kumar has given his confessional statement and in confessional statement, he has named this petitioner. During investigation, the house of the petitioner was searched and from his house, certain parts of the bike were recovered. It is said that the parts which were recovered from the possession of this petitioner matched with the looted bike. It is further submitted that the petitioner is languishing in judicial custody since 15.09.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baijnathpur P.S. Case No. 101 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
