2. The petitioner has prayed for bail in connection with Barh P.S. Case No.545 of 2024 registered for the offence punishable under Sections 137 and 96 of the BNS (359, 366-A of the IPC).
3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant. It has also been alleged that the petitioner was also having talks with the victim on mobile. During course of investigation, the victim was recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

From perusal of the order of the trial Court, it is clear that the victim has given her statement under Section 180 of the BNSS and has stated that she was in relation outside the marriage with the petitioner and has gone with her own sweet will. It has also been stated by the victim that she has gone to the house of her aunt. She has not made any statement against this petitioner. It is a case of adduced love affair. Petitioner is having no criminal antecedent. He is in judicial custody since 01.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Barh, District-Patna, in connection with Barh P.S.
