2. This is the second attempt of the bail of the petitioner. Earlier the prayer for anticipatory bail of the petitioner was rejected by this Court vide order dated 16.07.2024 passed in Cr. Miscellaneous No. 27656 of 2024.
3. The petitioner seeks regular bail in connection with Kamtaul P.S. Case No. 284 of 2023, registered for the offence punishable under Sections 328, 376, 341, 323, 504, 506/34 of the Indian Penal Code.
4. As per prosecution case, this petitioner dragged the informant and committed rape with the informant and also made video of the incident.

5. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to enmity. Earlier this informant was marriage with this petitioner in the year 2022 without consent of the family. After sometime, she performed second marriage with another person Md. Alamgir Ansari without taking divorce from the petitioner. When the husband of the informant namely Md. Alamgir saw the alleged photos and videos of the informant making consensual sex with this petitioner, he told the informant to leave and hence, this false and concocted case has been lodged. He further submits that compromise has taken place between both the parties. Petitioner is in custody since 24.07.2024.
6. Learned A.P.P. has vehemently opposed the prayer for bail of the petitioner.
7. Considering the nature of accusation against this petitioner, this application is dismissed.
