2. The petitioner apprehends his arrest in Bhagwanpur P.S. Case No. 139/2022 registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code pending in the Court of learned A.C.J.M. 1st, Vaishali at Hajipur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.85054 of 2023(2) dt.05-01-2024 2/2 order, preferably, on the same day, without being prejudiced by this order, considering the fact that the victim has solemnized marriage with the petitioner.
