JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-08-2018 The petitioner has approached this Court for release of his vehicle which has been seized and confiscated in connection with Bihpur (Jhandapur O.P.) P.S. Case No. 78 of 2017 instituted for the offence under Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016. The petitioner may avail of his remedies which are provided to him under the law for challenging the order passed in the confiscation proceedings.

The present petition with respect to release of the vehicle has become infructuous.

Patna High Court Cr. WJC No.1885 of 2018 (2) dt.07-08-2018 2/2 The same is therefore dismissed.

If the petitioner challenges the order of confiscation before the competent Court, the same shall be considered on its own merits without being prejudiced by the fact that the present petition has not been entertained.
