Petitioner seeks bail in a case registered for the offences punishable under Sections 302,201,328,34 of the Indian Penal Code.

Petitioner is wife of the deceased. Allegation is that the in-laws of the deceased including the petitioner committed murder by poisoning him to death.

Submission is that there is no direct evidence that the petitioner has poisoned her husband. Petitioner is mother of five months old child who is alongwith the petitioner is in custody. Petitioner is in custody since 24.05.2019. Only material is suspicion. Investigation of the case is already complete. Considering the fact that there is no direct material

No.76914 of 2019(2) dt.13-01-2020 2/2 against the petitioner as well as the fact that there is no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with G.R.No.3010 of 2018 arising out of Kharagpur Police Station Case No.320 of 2018, Tr. No.242 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
