1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2022.

3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and is in custody since 08.10.2024 and allegation is of recovery of 2395 litres of liquor from the house of Satyam, Sundram and Maksudan. It is next submitted that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession nor the place from where the recovery was made belongs to the petitioner nor petitioner has any concern with the accused persons from whose house the liquor was recovered.

4. Learned A.P.P. opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bibhutipur P.S. Case No.460/2023.
