JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No.3078 of 2017, disclosing offences under Sections 498A, 379, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.

As per F.I.R. there is general allegation against the petitioner, who happens to be the husband of the complainant of demand of dowry, for that, torturing her.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care. Considering the same, learned Sessions Judge has also issued notice to the complainant, but

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Vaishali at Hajipur, in connection with Complaint Case No. 3078 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition if the complainant appears and ready to reside with the petitioner, he has to keep her with dignity and care.
