The petitioner is in custody since 20.09.2019 in connection with Kotwali (Tilkamanjhi) P.S. Case No. 865 of 2019 for the offence registered under Sections 379 of the Indian Penal Code and subsequently section 411 of the Indian Penal Code was added.

Learned counsel for the petitioner submits that though the recovery of the TOTO Rickshaw was made from the possession of the petitioner, it is submitted that he had purchased the same from one co-accused Guddu Mandal as the said Guddu Mandal had stated that his mother was seriously ill and he in dire need of money. It is further submitted that after

No.76849 of 2019(2) dt.04-12-2019 2/2 arranging of Rs. 20,000/- the petitioner purchased the said Rickshaw from Guddu Mandal and it is in the confessional statement made before the police by the said Guddu Mandal that the petitioner is facing prosecution. It is further submitted that the petitioner has not been placed on T.I. Parade till date and he has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 865 of 2019.
