Informant, Rahish Kumar filed a written report on 03.02.2019 disclosing therein that while he along with his brother, Satyendra Yadav @ Chhotu Yadav (deceased) were returning, all of a sudden, eight persons intercepted them, out of whom, Nawal Kishore Pd. Yadav, Raj Nath Yadav, Sunil Yadav apprehended his brother while Vikram Yadav shot him dead. It has further been alleged that petitioner, Ram Swaroop Manjhi fired at the informant causing no harm.

From the case diary, it is evident that other co-accused are still evading their presence. However, considering the allegation in consonance with the period of custody since
