2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 24.04.2024 in Cr. Misc. No. 28131 of 2024.

3. The petitioner seeks bail in connection with Turkauliya P.S. Case No. 94 of 2024 registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code and Sections 20(b)(ii)(c) of the NDPS Act.

4. As per the prosecution case, 1 Kg 30 grams of Charas has been recovered from the vehicle in which the petitioner was found sitting.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge-II, NDPS, East Champaran/ concerned Court in connection with Turkauliya P.S. Case No. 94 of 2024, subject to the condition that both the bailors should be the close relative of the petitioner.

9. The petitioner will also mark attendance in Hasidhi Police Station, District-East Champaran, Motihari on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
