2. The petitioner seeks bail in a case registered for the offence punishable under Sections 379/414 of the Indian Penal Code and under Section 9/39/48(A)/51 of the Wild Life Protection Act, 1972.

3. The petitioner is said to be indulged in illegal business of conservative wild animals.

4. From perusal of the record, it appears that vide order dated 28.10.2021 passed in Cr. Misc. No. 26042 of 2021, the bail bond of the petitioner was cancelled on the ground of suppression of material fact.

5. Learned counsel for the petitioner submits that when the bail bond of the petitioner was cancelled by the

Patna High Court CR. MISC. No. 86012 of 2023(2) dt.05-01-2024 2/2 learned Court below, he suo motu surrendered on 05.09.2023 before the learned Court below. He further submits that other co-accused persons have been granted regular bail by the learned Court below itself.

6. Considering the facts and circumstances of the case and the fact that the petitioner has surrendered before the Court below after two years, I am not inclined to grant him privilege of bail.

7. Accordingly, the prayer for bail of the above named petitioner is rejected.
