2. Petitioner apprehends his arrest in connection with Benipatti P.S. Case No. 257 of 2023 dated 04.11.2023, registered for the offence punishable u/s 30(a), pending in the court of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail,
