Mr. Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 301 of 2019 dated 19.09.2019 instituted for the offence under Section 414 of the Indian Penal Code and under Sections 30(a) 32(2) and 41(1) of the Bihar Prohibition and Amended Excise Act, 2018.

The petitioner is in custody since 20.09.2019. It appears from the FIR that 462.900 litres of liquor was recovered from a vehicle in which the petitioner and two others were found to be sitting. Learned advocate for the petitioner submits that he had occupied the said vehicle as a gratuitous

Patna High Court CR. MISC. No.78846 of 2019(3) dt.17-03-2020 2/2 passenger and did not know that the consignment of liquor was being transported by the said vehicle. This Court has also been informed that one Pintu Kumar, who too was found sitting in the vehicle, has been granted bail by a bench of this Court.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned II Additional Sessions Judge-cum-Special Judge Excise, Gopalganj in connection with Kuchaikote P.S. Case No. 301 of 2019.

While saying so, the Court has also taken note of the fact that the petitioner has not been made accused in any case whatsoever apart from this case. (Ashutosh Kumar, J) krishna/- U T
