Mr. Anil Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 05-02-2025 Heard learned counsel for the petitioner, learned counsel for the O.P. No. 2 and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Vigilance P.S Case No. 8/2024 dated 03.09.2024 registered for the offence punishable u/s 7(a) of the Prevention of Corruption Act.

3. As per the prosecution case, the complainant has alleged that the petitioner demanded Rs. 15,000/- as bribe in order to write a report in favour of the complainant. Thereafter, on 09.08.2024, the complainant lodged FIR against the petitioner and it was found during investigation of the complaint that the petitioner after negotiation with the complainant

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that the entire allegation of accepting or recovery of bribe money is false and the reason that the prosecution has taken lame excuse that it was a dark night. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 05.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vigilance, North Bihar, Muzaffarpur in connection with Vigilance P.S. Case No. 08/2024, with the conditions:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable

7. The application stands allowed.
