2. The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149, 323, 302, 504 of the Indian Penal Code.

3. As per F.I.R., this petitioner alongwith other accused persons brutally assaulted father of the informant as a result of which, he died.

4. It is submitted on behalf of petitioner that due to previous enmity, this petitioner has been falsely implicated in this case. Though, there is allegation of assault by means of iron rod against this petitioner, but in the post-mortem report, no

Patna High Court CR. MISC. No.655 of 2024(4) dt.21-03-2024 2/2 external injury has been found on the person of deceased and thus, post-mortem report falsifies the prosecution case. In this case, chargesheet has already been submitted. Petitioner is in custody since 20.09.2023.

5. However, learned senior counsel for the informant vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Barh (Patna) in connection with Salimpur P.S. Case No. 160 of 2023.
