Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)A, 26 and 35 of the Arms Act. Six persons were apprehended from a four wheeler on suspicion that they were preparing to commit dacoity. Firearm etc. was recovered from possession of some other co-accused whereas from possession of the petitioner, only two mobile phones were recovered. Petitioner has stated in para 3 of the bail petition that prior to the present case, he was not involved in any other case. However, on the basis of confessional statement extracted by the police, petitioner has been named in some other cases also.
Considering the facts that there is no substantial

No.79922 of 2019(2) dt.05-12-2019 2/2 material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kasba Police Station Case No. 179 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
