The petitioner seeks bail in Harlakhi P.S. Case No.106 of 2017 registered for offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Allegation has been made that about 160 liters of Nepali liquor was recovered from two motorcycles, but the accused persons fled away leaving the motorcycles and the Chaukidar has identified the petitioner and other accused persons.

Counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and he is in custody since 18.10.2019 having clean antecedent.

No.78997 of 2019(2) dt.04-12-2019 2/2 Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-2nd-cum-Special Judge, Excise Act, Madhubani in connection with Harlakhi P.S. Case No.106 of 2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court/prosecution would be at liberty to take steps for cancellation of his bail bonds.
