JUSTICE HARISH KUMAR ORAL ORDER 10-12-2025 At the outset, learned Advocate for the petitioners seeks permission to withdraw the bail application on behalf of petitioner no.1, namely, Ranjit Paswan @ Ranjeet Paswan.

3. Heard the parties.

4. The petitioner nos. 2 and 3 are apprehending their arrest in connection with Kusheshwar Asthan P.S. Case No. 157 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

5. In the night of fateful day, when the informant

Patna High Court CR. MISC. No.81736 of 2025(2) dt.10-12-2025 2/3 reached to his Farm, in the meanwhile, the petitioner nos. 2 and 3 along with others came there and started abusing. When the same was protested, Ranjit Paswan assaulted the informant repeatedly by means of Farsa, due to which he sustained head injury. It is further alleged that thereupon co-accused Chhedi Paswan and Dipak Paswan also assaulted the informant, due to which he sustained serious injury. There is allegation of snatching golden chain against co-accused Runa Devi.

4. Learned Advocate for the petitioners submits that the genesis of the occurrence is nothing, but a land dispute. Moreover, even if the allegation is taken to be true, for the sake of argument, there is no specific allegation of causing any overt act against the petitioner nos.2 and 3. There is a counter version of the present case, being Kusheshwar Asthan P.S. Case No. 207 of 2025 instituted against the informant and others. The land dispute is also writ large for the simple reason that a Title Suit, bearing No. 349 of 2024, is pending between the parties. Moreover, the petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the

Regard being had to the submissions made on behalf of the parties and considering the nature of accusation against the petitioners, coupled with the case and counter case, as also the fair antecedent, let the petitioner nos. 2 and 3, in the event of their arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 157 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioners.
