The petitioner has prayed for bail in connection with Special Case No. 1211 of 2019 arising out of Araria P.S. Case No. 792 of 2019 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, 15 litres country liquor is said to have been recovered from three gallons from two accused persons including this petitioner.

It is submitted by learned counsel for the petitioner that allegation of recovery is false and concocted. The petitioner is in custody since 13.09.2019. He has no criminal antecedent and charge sheet has been submitted.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.75625 of 2019(2) dt.27-11-2019 2/2 taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Araria in connection with Special Case No. 1211 of 2019 arising out of Araria P.S.
