The petitioner seeks bail in connection with Special Case No.1155 of 2019 arising out of Palasi P.S. Case No.305 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is recovery of 13.500 liters of Nepali wine from the house of the petitioner, which is a joint family property. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent and petitioner is in jail custody since

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner subject to deposit of Rs.2,000/- in the Patna High Court Legal Services Committee, Patna. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions-cum-Special Judge, Araria in connection with Special Case No.1155 of 2019 arising out of Palasi P.S. Case No.305 of 2019.
