JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2020 The petitioner, who is in custody since 26.07.2019, seeks bail in connection with Rajpur P.S. Case No. 90 of 2019, dated 26.07.2019, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b), 26 and 35 of the Arms Act.

It has been submitted on behalf of the petitioner that from his possession four cartridges have been recovered. The motorcycle, which is said to have been recovered during the raid, belongs to the petitioner and about which there is no dispute whatsoever. The firearm weapon is stated to have been recovered from one of the other accused persons.

In two of the cases which arise out of a family dispute, the petitioner is on bail. In the third case also which has been lodged under Section 392 of the Indian Penal Code, the petitioner has been granted bail. Considering the period of custody of the petitioner and the nature of accusation, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramgnaj, Rohtas in connection with Rajpur P.S. Case No. 90 of 2019. The application stands allowed.
