2. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 323, 379, 386, 325, 504, 506, 307, 147, 148 and 149 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others are said to have demanded extortion (Rangdari) from the victim and, thereafter, assaulted him.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 05.07.2023, he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. The police after investigation did not submit

Patna High Court CR. MISC. No.3138 of 2024(2) dt.31-01-2024 2/2 chargesheet under Section 307 of the Indian Penal Code but the cognizance has been taken under Section 307 of the Indian Penal Code.

7. Considering the period of custody, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur/concerned Court below in connection with Nathnagar P.S. Case No. 443 of 2023 subject to the condition that:- 8(1). The petitioner will mark his attendance at the Barari, Bhagalpur Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
