The petitioner apprehends his arrest in connection with Excise Case No. 372 of 2019, registered under Section 30(a) of the Bihar Excise Act.

The accusation is that on receiving secret information about preparing country made liquor by the petitioner in village Barari, the informant along with other police personnel reached there. On search near the pond, one Jerkin containing 10 litres country made liquor, i.e, 1K.M. far away from the village Barari was recovered.

Learned counsel for the petitioner submits that it would appear from the prosecution report that petitioner was not

Patna High Court CR. MISC. No.76601 of 2019(2) dt.03-02-2020 2/2 seen at the spot and nothing was recovered from his possession but mere on suspicion, his name has surfaced in the present case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Sheikhpura, in connection with Excise Case No. 372 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
