2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

4. It is a case of commission of murder to the informant's son, namely, Md. Faizal by gunshot injury by several accused persons including the petitioner.

5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that no one is an eye witness of the alleged occurrence and only

He next submits that similarly situated co-accused persons have already been granted bail by this Court passed in Cr. Misc. Nos. 8590 of 2023, 2359 of 2024, 32662 of 2023, 33331 of 2023, 34778 of 2023, 32662 of 2023, 33331 of 2023, 11915 of 2023, 48112 of 2023, 5754 of 2024 and 1328 of 2024. Petitioner is in custody since 26.07.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 7.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail after framing of the charge in connection with Gaya P.S. Case No.511 of 2022 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Gaya. 8.

The trial court is directed to conclude the proceeding of framing of charge according to law within a period of 15 (fifteen) days from the date of receipt of a copy of this order. However, it is made clear that if the charge-sheet has not been submitted then the above named petitioner shall be released on bail on furnishing bail bond with further condition
