The petitioner seeks regular bail in connection with Harsidhi P.S.Case No.314 of 2019 registered for offences punishable under Sections 363, 366A of the Indian Penal Code. As per FIR, there is allegation against the petitioner of kidnapping of the minor daughter of the informant. Submission of the learned counsel for the petitioner is that statement of the girl after recovery has been recorded in which she has stated that she had gone on her own sweet-will with the petitioner. She has disclosed her age as 18 years whereas the court has assessed her age as 17 years. He is in custody for more than three months. Charge sheet has been submitted.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Harsidhi P.S.Case No.314 of 2019.

With the above direction, this application is allowed.
