2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 20, 22, 23, 27(A) of the NDPS Act.

3. As per prosecution case, the police apprehended one Saurabh Kumar with 1.05 kg of charas. Petitioner is alleged to be the person who fled away.

4. It is submitted by learned counsel appearing on behalf of the petitioner that name of the petitioner has transpired in this case on the basis of confessional statement of co-accused Saurabh Kumar. Except confessional statement, there is no material on record to connect the petitioner with the alleged incident. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.2999 of 2024(3) dt.07-03-2024 2/2 possession of the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail and submitted that petitioner has got three other criminal antecedents.

6. Considering the aforesaid facts and circumstances and criminal antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
