JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This application, for grant of anticipatory bail, arises out of Phulwaria P.S. Case No. 127 of 2019, disclosing offences under Section25 (1-b)a, 26 of the Arms Act and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that police on secret information that accused Shivam Kumar is engaged in sell of liquor, on which, the police raided the house of Shivam Kumar and recovered 1.5 litres of liquor as well as one country made pistol and the said Shivam Kumar disclosed the name of petitioner and one Deepak Choudhary as their associates in sell of liquor, who happen to be father and brother of said Shivam Kumar.

No.86639 of 2019(2) dt.22-01-2020 2/2 Submission of learned counsel for the petitioners that he has no criminal antecedent and has falsely been implicated in this case and he has been made accused in this case only because he happens to be father of co-accused Shivam Kumar on whose confession the name of petitioner transpired and except that there is nothing against the petitioner. Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-Begusarai -cum-Special Judge, Excise Act, Begusarai, in connection with Phulwaria P.S.
