Learned counsel for the petitioner submits that the writ application has been filed for a direction upon the respondent authorities, particularly respondent no. 3, to consider and pass appropriate orders with respect to the pay fixation of the petitioner, the details of which has been forwarded to respondent no. 3 by respondent no. 4 and is pending consideration, and also to direct grant of consequential benefits

Patna High Court CWJC No.19843 of 2025(2) dt.09-12-2025 2/3 for which the petitioner may be entitled in the facts and circumstances of the case.

At the outset, learned counsel for the petitioner by referring to the order dated 17.02.2025, passed by the District Magistrate, which has been appended with the writ application as Annexure-P/3, submits that the issues are required to be adjudicated at the level of the Director, Primary Education, Department of Education, Government of Bihar/ respondent no.3 and for that the necessary details have already been sent by the District Magistrate, Kishanganj, vide letter dated 22.04.2025. He further submits that respondent no.3 may be directed to adjudicate the claim of the petitioner in the light of the order passed and the details forwarded by the District Magistrate, Kishanganj, whereby the entire records have been sent for deciding his claim by the Director, Primary Education, Department of Education, Government of Bihar/ respondent no.3.

4. On the other hand, learned counsel for the State submits that the matter may be directed to be adjudicated by respondent no. 3 within a stipulated time frame.

5. Considering the aforesaid, the petitioner is directed to file a detailed representation along with all supporting

Upon receipt of such representation, respondent no. 3 shall adjudicate the claim of the petitioner within a period of six weeks from the date of submission of the representation. If, upon adjudication, the claim of the petitioner is found to be genuine, the consequential benefits shall be extended to him within a further period of four weeks thereafter.

6. It is made clear that, if required, personal hearing may be afforded to the petitioner by issuing notice with proper communication.

7. With the aforesaid observation and direction, the instant writ application stands disposed of.
