The petitioner seeks bail in Madhuban P.S. case No.231 of 2018 registered under Sections 304B/34 of the Indian Penal Code, pending in the court of 4th Additional Chief Judicial Magistrate, Motihari, East Champaran.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner happens to be the husband of the deceased.

A report was called for from the trial court. It has been reported that all the non-official witnesses have been examined. Only official witnesses i.e. Investigating Officer and the doctor are to be examined in the present case.

Patna High Court CR. MISC. No.77213 of 2019(3) dt.04-03-2020 2/2 Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order. The District Magistrate, East Champaran, Motihari, the Superintendent of Police, East Champaran at Motihari and the Civil Surgeon, East Champaran at Motihari are also directed to ensure that the official witnesses i.e. the Investigating Officer and the doctor are produced in the court below on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, East Champaran, Motihari, the Superintendent of Police, East Champaran at Motihari and the Civil Surgeon, East Champaran at Motihari.
