====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 120(B), 420, 467, 468, 471 and 477A of the Indian Penal Code and Sections 13(2) and 13(1)(d) of Prevention of Corruption Act, 1988. Annexure-2 series would reveal that similarly situated some other co-accused were allowed anticipatory bail or regular bail by different co-ordinate Benches of this Court including by this Bench.
Learned counsel for the C.B.I. opposed the prayer for bail.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.50736 of 2018(2) dt.24-08-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Special Case No.04 of 2013, arising out of C.B.I./A.C.B./R.C. Case No.3(A) of 2013, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
