2. With the consent of all the parties, this writ application is being disposed of at the present stage itself.

3. This writ application has been filed for the grant of following reliefs:- "i.) For direction the Respondents for transfer and posting to the petitioner from Middle school Murhari BlockHarnaut District-Nalanda to Ramcharan Middle school

2/4 Sohsarai, Block-Bihar Sharif, Nalanda as Headmaster in which school the petitioner has been discharging duty as deputation by office order vide Memo No 395 dated 22-02-2023 on the ground the safety of life and property because the present Headmaster of this school is going on retire from service on 30-11-2025 or any other govt school under Bihar Sharif Block, Nalanda ii.) For restraining the respondents vacating deputation of the petitioner from Ramcharan Middle school Sohsarai, BlockBihar Sharif, Nalanda to Middle school Murhari Block-Harnaut District-Nalanda till posting in another school because the petitioner is unable to discharge his duty in parent school due to physical and mental harassment of representative of local Mukhia with the help of present Headmaster.

iii.) For passing such order and direction in the interest of justice and ends of justice of the petitioner in the facts and

After advancing some argument, learned counsel for the petitioner submits that for seeking the reliefs as claimed for in the present writ application, the petitioner is prepared to file a detailed representation before the District Education Officer, Nalanda (Respondent No. 4) and he further prays that if such a representation is filed, an appropriate direction be given to the District Education Officer, Nalanda (Respondent No. 4) to dispose of the representation within a fixed time frame after giving an opportunity of hearing to the petitioner.

5. To this prayer being made by learned counsel for the petitioner, the learned counsel for Respondent-State does not have any objection.

6. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a detailed representation before the District Education Officer, Nalanda (Respondent No. 4) within one month from the date of passing of this order. If such a representation is filed by the petitioner within a stipulated time then the District Education Officer, Nalanda (Respondent No. 4) shall dispose of the same on merit within a further period of four months from the date of filing of the representation after giving an opportunity of hearing to the

4/4 petitioner, by passing a reasoned and speaking order. Let it be made clear that this Court has expressed no opinion on the merits of the issue and the District Education Officer, Nalanda (Respondent No. 4) will be at liberty to dispose of the representation of the petitioner based on his understanding of the issue on merit.

7. With the aforesaid observation, directions and liberty granted, this writ application is disposed of. All pending Interlocutory Applications, if any shall stand disposed of. (Alok Kumar Sinha, J) Gaurav Sinha/- U
