JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-10-2018 The petitioner is in custody since 16.07.2018 in connection with Special Case No. 04 of 2013 arising out of C.B.I./A.C.B/R.C. Case No. 3(A)/2013, registered for offences punishable under Sections 120(B) r/w 420, 467, 468, 471, 477(A) of the Indian Penal Code and Section 13(2) r/w Section 13(1)(d) of Prevention of Corruption Act.
Allegation against the petitioner is of getting appointment in the post office on the basis of fake certificate issued by Bihar Sanskrit Shiksha Board.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the other co-accused having similar allegation has been granted privilege of bail by different Coordinate Benchs of this Court including vide
Patna High Court Cr.Misc. No.49602 of 2018 (4) dt.04-10-2018 2/3 order dated 24.08.2018 passed in Cr. Misc. No. 50736 of 2018. Heard learned standing counsel for the C.B.I. also. Having heard both sides and considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-II, Patna, in connection with Special Case No. 04 of 2013 arising out of C.B.I./A.C.B/R.C. Case No. 3(A)/2013, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing
