The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 30 (a) and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, 37 litres of country liquor is said to have been recovered from a motorcycle on which two accused persons including this petitioner were riding. It is submitted by learned counsel for the petitioner that the allegation of recovery of liquor from the motorcycle is false and concocted, he has no criminal antecedent and is in custody since 04.09.2019. It is further submitted that charge sheet has been submitted in the case.

The application for bail has been opposed by learned

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Saharsa in connection with Special (Excise) Case No. 420 of 2019 (arising out of Saharsa Sadar P.S. Case No. 793 of 2019).
