====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 31-01-2024 Heard Mr. Mritunjay Kumar, learned counsel appearing on behalf of the petitioner and Mrs. Asha Devi, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Patepur P.S. Case No. 18 of 2023 registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the petitioner had kidnapped the minor daughter of the informant with an intention to marry.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner and the victim were in love relationship and they had eloped and thereafter they engaged in matrimonial relationship by getting registered under the Hindu

Patna High Court CR. MISC. No.1706 of 2024(2) dt.31-01-2024 2/2 Marriage Act. The petitioner is also blessed with a child and both the parties are living happily.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the fact that the victim has not complained against the petitioner and they are now married having a child and living together happily, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Patepur P.S. Case No. 18 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
