2. Petitioner apprehends his arrest in connection with Sakra P.S. Case No. 546/2018, registered for the offence punishable u/s 379 of the IPC, pending in the court of learned A.C.J.M.-10, Muzaffarpur (East).

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in

Patna High Court CR. MISC. No.87584 of 2024(2) dt.19-12-2024 2/2 accordance with law without being prejudiced by this order keeping in view the judgment of the Apex Court in the case of Satendra Kumar Antil v/s. Central Bureau of Investigation & Anr. reported in (2022) 10 SCC 51 as well as considering the fact that maximum period of punishment for the alleged offence is three years.
