The petitioner seeks bail in connection with Special Case No.18 of 2019, arising out of Patrakarnagar Police Station Case No.583 of 2019 registered under Sections 419 and 420 of the Indian Penal Code besides Sections 21 and 23 of the N.D.P.S. Act, Sections 27(b)(ii), 27(d), 28 and 28A of the Drugs and Cosmetics Act and Section 30 of the Bihar Prohibition and Excise Act, 2016 (later deleted).

The accusation is that on search, the petitioner was found in possession of several bottles of cough syrup but, on demand, he did not produce the paper regarding the same. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.81264 of 2019(2) dt.18-12-2019 2/2 submits that the petitioner has falsely been implicated in this case on mere suspicion, while he had gone to Bus Stand, Patna, to pickup the bus for going to Araria. The petitioner has no criminal antecedent and is in custody since 31.07.2019. Further submission is that, on investigation, chargesheet has already been submitted against the petitioner by the police. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Patna, in connection with Special Case No.18 of 2019, arising out of Patrakarnagar Police Station Case No.583 of 2019.
