2. The present application has been filed for modification of order dated 05.10.2023 passed in Cr. Misc. No. 42871 of 2023 to the extent of extending the period of returning the rest of the principal amount to the informant.

3. Learned counsel for the petitioner submits that the petitioner tried to arrange the said amount within stipulated period of two months, but due to some mis-happening, the said amount could not be arranged, accordingly it could not be paid to the informant till today. He further submits that the petitioner has paid Rs.50,000/- in the account of the informant out of Rs. 4,35,000/- (i.e. rest principal amount).

4. After hearing learned counsel for the petitioner and for the reasons mentioned in the modification application, the period for returning the rest of principal amount to the informant is extended by three months from the date of receipt/production of a copy of this order in connection with Pirbahore P.S. Case No. 229 of 2021.

5. The order dated 05.10.2023 is modified to the extent as indicated above.

6. Accordingly, this modification application stands disposed of.
