====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-01-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 303(2), 308(2), 308(4), 351(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. According to F.I.R., this petitioner and other accused persons used to demand ransom from the son of informant and on the alleged date of occurrence, while he was returning home from his coaching, all the accused persons assaulted him with lathi, iron rod. Allegation against the petitioner is to assault the son of informant with butt of pistol.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.86519 of 2024(3) dt.28-01-2025 2/2 petitioner is innocent and has falsely been implicated in this case due to village politics. Injury allegedly caused by the petitioner is simple in nature.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the simple injury and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Gaya in connection with Buniyadganj P. S. Case No. 200 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
