The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 387, 307/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of Arms Act.

As per the allegation in F.I.R., petitioner along with other co-accused persons are engaged in assaulting the labourer of Om Construction and were threatening the local people. They were searching for the owner and

It is further submitted that when police chased them and in the course of firing co-accused persons were apprehended. Petitioner along with other co-accused person were alleged have fled away from the place of occurrence.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case due to high handedness of police. The petitioner has no concern either with the alleged recovery or with other co-accused persons. Neither the petitioner was apprehended on spot nor anything incriminating has been recovered from his conscious possession. His name sprang up in this case on the confessional statement of co-accused Md. Sajjad and Md. Sohel. It is also submitted that petitioner is languishing in judicial custody since 31.08.2023. Similarly situated co-accused, namely, Gulshan Kumar @ Gulshan Singh has already been granted bail vide

Patna High Court CR. MISC. No.86303 of 2023(2) dt.11-01-2024 3/3 order dated 22.09.2023, passed in Cr. Misc. No. 60853 of 2023 by this Court Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Teghra P.S. Case No. 89 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial magistrate 1st Class, Begusarai.
