The petitioner seeks regular bail in connection with Kasba P.S. Case No. 156 of 2019 registered for the offence under Sections 302 and 201 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. rather her name transpired in this case during course of the investigation. She has falsely been implicated in this case. The petitioner is languishing in judicial custody since 23.08.2019.
Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioner who happens to be second
Patna High Court CR. MISC. No.82374 of 2019(3) dt.01-06-2020 2/2 wife of the deceased has illicit relation with co-accused Maseek Alam and both of them have also confessed their involvement in the alleged crime. Moreover, prosecution witnesses have also supported the prosecution version which is evident from paragraphs 2, 8, 9, 24, 26, 27 and 50 of the case diary. Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
