1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Rivilganj / Rivelganj / Revilganj P.S. Case No. 270 of 2025 dated 20.08.2025 registered under Sections 30(a) of the Bihar Prohibition and Amendment Act.
3. As per the first information report 12.995 liters of English wine and 45 liters of country made liquor has been recovered from a place situated nearby the house of the petitioner and one person taking advantage of darkness fled away from the place of occurrence.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The name of the petitioner transpired on the basis of information provided by ALTF Officer on suspicion only. The place of occurrence is an open space situated at a distance of 10 KM East nearby the house of the petitioner which is easily accessible to all and sundry. There is no recovery of illicit liquor from inside the house of the petitioner. The petitioner has two criminal antecedents out of which one case relates to Excise Act.

Regard being had to the submission made by the parties, taking into consideration the fact that recovery of illicit liquor is not from inside the house of the petitioner rather the same has been seized from an open space accessible to all and sundry, accordingly , I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge Excise 2nd , Saran at Chapra in connection with Rivilganj / Rivelganj / Revilganj P.S. Case No. 270 of 2025 subject
