2. The petitioners have prayed for bail in connection with Madanpur P.S. Case No. 199 of 2025 registered for the offence punishable under Sections 308(3), 308(4), 3(5) of the B.N.S., 2023 and Sections 13, 16, 17 and 20 of the U.A.P. Act.

3. The case of the prosecution in short is that the informant is the site in-charge of M/s Pushpanjali Epicon Ltd. and currently the site in-charge of the construction of the drain near Anjanwa. On 15.05.2025 at about 11:30 PM near Anjanwa Hill, Poklane machine operator Umesh Kumar and night guard Santosh Yadav were sleeping. At that time, 10-15 unknown persons came with weapons and woke up the operator and asked who the contractor was. The operator said he didn't know, then they took their mobile bearing numbers 9204885804 and 9065481663 and went away by saying to tell the contractor to come and contact. On 16.05.2025, when the informant called them, they said they are Maoist. One Rahul Kumar was apprehended in Gurua P.S. Case No. 232 of 2025, and in that case he has given his confessional statement, and on the basis of his confessional statement, these petitioners are apprehended in this case.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. He also submits that petitioner no. 2, namely, Rishikesh Kumar @ Dr. Riki, is a quack (rural medical practitioner), whereas petitioner no. 1, namely, Dilip Kumar, is a compounder. It has further been submitted that nothing has been recovered from their possession. It has also been submitted that a statement has been

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 199 of 2025.
