2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 317(5) and 55 of the BNS and Sections 25-1 AA), 26 and 35 of the Arms Act registered in connection with Musahari P.S.Case No. 268 of 2024.
3. According to allegation, one automatic pistol and eight live cartridges were recovered from the waist of the petitioner.
4. Mr. Anshul, the learned senior counsel for the petitioner while making a prayer for bail, has submitted that, although the bail application of the petitioner was rejected by this Court, vide Cr.Misc.No. 16535 of 2025 under order dated
Patna High Court CR. MISC. No.81707 of 2025(2) dt.28-11-2025 2/2 12.05.2025, but the petitioner has remained in custody for more than a year, whereas the offence is punishable with imprisonment for three years.

Considering the above facts and circumstances, let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned In-charge Judicial Magistrate Muzaffarpur in connection with Musahari P.S.Case No. 268 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed in the court below till conclusion of trial, and if he fails to appear on two consecutive dates, unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
